JP Morgan Reveals Why Ethereum Might Not Qualify as a Security

Exploring Key Developments within the Ethereum Network that Challenge its Classification under Securities Law Amidst SEC Investigation

"JP Morgan Reveals Why Ethereum Might Not Qualify as a Security"

Key Points

  • JP Morgan’s Global Markets Strategy team has analyzed key developments within the Ethereum network that could impact its classification under securities law.
  • The Ethereum community has reacted positively to these developments, seeing them as a step towards a more decentralized and healthy ETH staking ecosystem.
  • JP Morgan’s Global Markets Strategy team has recently conducted an analysis of the Ethereum network. This analysis comes at a crucial time for Ethereum, as it is currently under investigation by the US Securities and Exchange Commission (SEC).

    Decentralization of Ethereum

The report from JP Morgan emphasizes the decreasing share of staked ETH by Lido. A year ago, Lido held about a third of the staked ETH, but it now holds approximately a quarter. This shift towards a more decentralized staking ecosystem could potentially lessen regulatory concerns about centralization within the Ethereum network.

The report said, “Positive for the Ethereum network, the share of Lido in staked ETH has decreased further from around one third a year ago to around a quarter at the moment. This should reduce concerns about concentration in the Ethereum network, thus raising the chance that Ethereum will avoid being designated as security in the future.”

The team also referred to the “Hinman documents” that were released last June. These documents have significantly influenced the SEC’s position on digital tokens. They suggest that the degree of network decentralization is essential as tokens on a sufficiently decentralized network may not be classified as securities.

The Ethereum community has shown a positive response to these changes. Anthony Sassano, founder of The Daily Gwei and co-founder of EthHub, commented on the decreasing dominance of Lido. He attributed this to increased competition in the staking space, which he believes is a step towards a more decentralized and healthy ETH staking ecosystem.

However, opinions on the current restaking projects are varied. Some users are questioning if restaking projects “are better.” In response, Sassano argued that this debate can only be had once there is a vibrant free market of Ethereum staking projects, not just a few that dominate most of the market share.

Seraphim, head of growth at Ethena Labs, offered a pragmatic perspective on the situation. He suggested that offering better yields is a more effective strategy than criticism.

JP Morgan’s report also discussed the Dencun upgrade’s importance. This upgrade is a significant technological advancement for Ethereum since the previous Shanghai upgrade. The Dencun upgrade has “significantly reduced the transaction costs on Ethereum layer 2,” according to the report.

Looking forward, the anticipated Petra upgrade is expected to introduce Verkle trees. This will facilitate efficient data storage and further enhance Ethereum’s scalability and efficiency. The report optimistically notes, “Petra… would introduce features like Verkle trees for efficient data storage which aim at simplifying block verification by pruning historical blocks older than one year, thus conserving storage and bandwidth.”

At the time of the report, ETH was trading at $3,275.
