The Securities and Exchange Commission (SEC) has been investigating Ethereum (ETH) with the intention of classifying it as a security.
The investigation is centered around Ethereum’s transition to proof-of-stake governance in September 2022 and the concentration risks associated with ETH staking, particularly on platforms like Lido.
Decrease in Lido’s Staked Ethereum Share
JPMorgan has noted a significant shift in sentiment, with increasing optimism about Ethereum avoiding the security label.
This shift is due to the staking platform Lido seeing a decrease in its share of staked Ether, as stated by Nikolaos Panigirtzoglou, a JPMorgan executive.
He suggested that this decrease should help alleviate concerns about concentration in the Ethereum network, thus increasing the likelihood of Ethereum avoiding security designation.
Significance of Network Decentralization
The Hinman documents, made public in June 2023, emphasize the importance of network decentralization in the SEC’s evaluation of digital tokens as securities.
If tokens on a network exhibit enough decentralization, they are less likely to be classified as securities by the SEC.
JPMorgan pointed out that the Hinman documents could influence the direction of current U.S. congressional efforts to regulate the crypto industry, potentially helping Ethereum avoid security designation.
Furthermore, the Howey test suggests that any transaction deemed an investment contract is classified as a security.
If Ethereum manages to avoid this classification, it would be another significant win for the cryptocurrency community, following the example set by Ripple’s XRP.
These challenges have directly impacted Ethereum’s price performance in Q2 2024, with the cryptocurrency experiencing fluctuations throughout the period.
However, if Ethereum can replicate XRP’s success in avoiding security designation, it could potentially trigger a substantial increase in Ether’s value and pave the way for the approval of its Exchange-Traded Funds (ETF).
