The recent court ruling in favor of private fund managers determined that the U.S. Securities and Exchange Commission (SEC)’s heightened regulation for private fund advisers will not be enforced.
The SEC had adopted a rule to reinforce the regulation of private fund advisers with the aim of protecting investors and deterring fraud. However, this “Final Rule,” which was slated to be incorporated into the Code of Federal Regulations, was contested by several private fund manager associations and ultimately overturned by the United States Court of Appeals for the Fifth Circuit.
Implications for the Crypto Market
The “Final Rule” could have significantly affected the SEC’s capacity to enforce disclosure mandates on crypto firms.
SEC Chair Gary Gensler emphasized the significance of disclosure in a recent CNBC interview, stating that crypto markets are not providing adequate disclosure to investors. However, he also noted that disclosure alone cannot protect against market manipulation.
Ripple’s CLO, Stuart Alderoty, expressed his dissatisfaction with the SEC’s attempts to extend its jurisdiction in the crypto market. This development comes as Ripple awaits a court decision in its case against the SEC.
Prospects for an XRP ETF
Despite the ongoing legal dispute between Ripple and the SEC, speculation is rife about the potential launch of XRP ETFs.
With the SEC’s approval of Bitcoin spot exchange-traded funds (ETFs) and Ethereum ETFs nearing launch, some believe the SEC might be adopting a more favorable stance towards cryptocurrencies. Ripple CTO Brad Garlinghouse recently echoed these sentiments, stating that an XRP ETF is “simply inevitable.”
Additionally, Ripple’s President Monica Long has suggested that the company’s highly anticipated stablecoin is likely to debut this year.
