The analysis by Jim Iuorio of JI Financial highlighted how legislative progress may influence institutional positioning as much as price movements.

Recent price action showed Bitcoin rallying above $80,000 before retreating toward $77,000, closely mirroring weakness in technology stocks.

This continued alignment has raised questions among investors who viewed the asset as non-correlated or a hedge against dollar exposure.

CME has also announced plans to expand crypto derivatives access to 24/7 trading, pending regulatory approval, reflecting growing institutional demand for around-the-clock risk management tools.

Digital Asset Market Clarity Act and Regulatory Structure

The Digital Asset Market Clarity Act, approved by the House in 2025, is awaiting further action in the Senate after review by the Banking Committee in May 2026.

The bill seeks to clarify jurisdictional boundaries between the Securities and Exchange Commission and the Commodity Futures Trading Commission.

Under the proposal, Bitcoin and Ethereum (ETH) would be formally defined as digital commodities, placing them under primary CFTC supervision.

This designation would align them with traditional commodities such as oil and gold and remove ambiguity tied to the Howey test framework.

The classification would apply once a digital asset meets decentralization standards and lacks a controlling issuer, transferring oversight authority from the SEC to the CFTC.

In such cases, SEC registration and disclosure rules would no longer serve as the main compliance structure.

The legislation also outlines registration requirements for digital commodity exchanges, brokers, and dealers.

It would harmonize crypto trading venues with existing futures and swaps regulations under the Commodity Exchange Act.

Market Implications for Derivatives and Institutional Flows

Delays in Senate approval through 2025 and 2026 have been cited by CME analysts as contributing to caution among institutional participants.

Some analysts observed that futures markets have led price stabilization while spot allocations remained muted amid regulatory uncertainty.

The Coinbase Premium Index stayed negative for much of 2025, signaling restrained institutional spot demand relative to derivatives activity on platforms such as Coinbase.

This divergence has reinforced the view that legislative clarity may influence capital deployment decisions.

Prediction markets currently estimate moderate odds of Senate passage in 2026.

These expectations have become inputs in volatility pricing for CME-listed Bitcoin options, reflecting the bill’s perceived importance to market structure development.
