Larry Fink, CEO of BlackRock, recently shared his thoughts on the likely approval of an Ethereum ETF.

During an interview with FOX Business, Fink was questioned about the possibility of initiating an Ethereum ETF, even if Ethereum is classified as a “security”. He responded affirmatively, asserting that such a designation wouldn’t hinder ETF approval.

Market Reactions and Speculations

Fink’s comments have sparked a flurry of speculation within the crypto community. Nate Geraci of ETF Store, for instance, shared his interpretation of Fink’s comments on X (formerly Twitter).

Geraci suggested that the SEC might be seriously considering classifying Ethereum as a security, which could complicate the approval of a spot Ethereum ETF. However, he also noted Fink’s belief that the SEC could still permit a spot Ethereum ETF, even after such a classification.

The Role of ‘Staking’ in ETF Filings

Another point of contention in the Ethereum ETF approval process is the recent inclusion of “staking” in amendments by prospective issuers.

On March 27th, Fidelity updated its Ethereum ETF filing to incorporate staking for users. The amendment indicated that the trust may engage in staking activities and expects to receive certain staking rewards of Ethereum, which could be treated as income for federal income tax purposes.

Similarly, Grayscale’s Ethereum ETF filing also included staking. The SEC’s stance on staking, however, has been somewhat wary, as demonstrated during the Kraken lawsuit in 2023.

The SEC warned that investors who provide tokens to staking-as-a-service providers risk losing control of those tokens and are exposed to associated platform risks, with minimal protection.

Eric Balchunas, a Bloomberg ETF analyst, suggested that the inclusion of staking in filings is a strategy by hopeful issuers to influence the SEC. Despite this, he maintains a pessimistic 25% chance of May approval for Ethereum ETFs.

However, Fink’s optimistic outlook on approval, even if Ethereum is classified as a “security”, is of significant interest. If Fink’s perspective proves accurate, an Ethereum ETF may be on the horizon regardless.
