Failure to Prevent Money Laundering
The charges against Zhao stem from his alleged inability to halt widespread money laundering on the Binance platform. This marks a noteworthy turn of events in the ongoing discussions about him.
The Justice Department, in a sentencing memorandum filed last week, stated that Zhao’s violation of U.S. law was neither an accident nor an oversight.
They further claimed that Zhao deliberately chose to break U.S. law as a business strategy to attract users, grow his company, and increase his wealth.
This sheds light on Zhao’s alleged failure to establish an effective anti-money laundering program as required by the Bank Secrecy Act.
The decision to propose a three-year prison term, which is more than the recommended 18 months, highlights the seriousness of Zhao’s alleged offenses and the importance of strict legal compliance.
Zhao is accused of enabling Binance to process transactions related to illegal activities, including those involving Americans and sanctioned individuals.
Prosecutors attribute unreported suspicious transactions and inadequate controls to Zhao’s leadership. They have also highlighted the involvement of certain designated terrorist groups, such as Hamas and al-Qaida.
In response to the allegations, Zhao resigned as CEO of Binance in November of last year, and recently, he admitted to violating the Bank Secrecy Act.
