Consensys, a major player in the blockchain software industry, has recently made headlines by taking legal action against the United States’s SEC and its commissioners. The lawsuit is centered around the ongoing debate concerning the potential classification of Ethereum (ETH) as a security.

The Lawsuit Against the SEC

Laura Brookover, Senior Counsel & Head of Litigation and Investigations at Consensys, spoke about the lawsuit on a recent episode of “Unchained.” She expressed surprise at finding herself in a legal battle with the SEC, but emphasized the importance of defending Ether and the Ethereum network from what she referred to as Chair Gensler’s unlawful power grab.

Brookover disclosed that the SEC’s investigation extends beyond Consensys’s product, Metamask, to include their finance team. The SEC has been probing into the sales of Ether and the activities of Ethereum developers.

Consensys’s Stand on Ether’s Classification

Consensys has firmly disputed the SEC’s theory that staking converts Ether into a security. Brookover challenged the SEC’s differentiation between the Bitcoin (BTC) and Ethereum ecosystems, arguing that treating them differently is arbitrary and baseless.

However, opinions on Ether’s classification as a security vary within the industry. Steven Nerayoff, a former Ethereum advisor, posits that Ethereum has functioned as a centralized entity since its ICO, which would warrant its classification as a security.

Brookover also addressed the SEC’s Wells notice that accused Consensys of operating as an unregistered securities broker, specifically referencing Consensys’s Metamask swaps and staking features. She argued that Metamask serves as a communication tool for liquid staking protocols, rather than participating in securities distribution.

Brookover remains hopeful that a favorable outcome in the lawsuit will bring clarity to the regulatory uncertainty surrounding cryptocurrencies.
