The regulatory battle between the Securities and Exchange Commission (SEC) and crypto-entities in the United States is intensifying, with the latter accusing the former of overstepping its boundaries.

Consensys Takes Legal Action Against SEC

Consensys, a blockchain software technology firm, has escalated the situation by taking the SEC to court. The company’s CEO, Joe Lubin, criticized the SEC’s approach towards Ethereum, suggesting that the U.S. is trying to disconnect from the platform.

Lubin believes that the SEC’s scrutiny goes beyond Ethereum’s classification and extends to actions taken by software developers. This, he fears, could have a broader impact on the entire crypto industry and hinder innovation.

SEC’s Inquiry into Ethereum

Consensys’ General Counsel, Matt Corva, highlighted the uniqueness of this case, emphasizing that Ethereum itself is under attack. He expressed concern that the SEC is overstepping its authority by acting as the police of open-source technology.

The SEC’s inquiry is focusing on contributors to Ethereum Improvement Proposals (EIPs), demonstrating the extensive nature of the investigation.

Corva dismissed theories linking the SEC’s actions to Ethereum’s shift to proof of stake, calling it a “foolish theory”. He also expressed uncertainty about Consensys’ own actions against the SEC, acknowledging potential harm to the prospects of the Ether spot ETF approval.

The question arises – Could Consensys’ legal action hinder the approval of the spot Ethereum ETF? Corva responded that they wouldn’t need to bring the Ethereum action if the SEC was going to approve the Ethereum ETF.

Their case is not solely based on this broader narrative but focuses on specific facts regarding the SEC’s involvement in Ethereum. Winning the case could establish Ether as a commodity, potentially influencing how the SEC regulates assets and non-custodial wallets like Metamask.
