Nerayoff has suggested that the current situation is a tactic executed by Consensys, Ethereum, and the SEC to create uncertainty.
He further alleges that Ethereum has functioned as a centralized entity since its ICO and should be considered a security.
Claims of Securities Fraud
Nerayoff has also claimed that the speculative ICO purchases and hidden whales are clear signs of major securities fraud.
This claim is supported by SEC Chair Gary Gensler’s disclosure that Lubin obtained 9.5% of the ICO.
