The Securities and Exchange Commission (SEC) appears to be preparing to enforce stricter regulations on cryptocurrencies.

This trend is underscored by the SEC’s recent legal disputes with a number of crypto firms, including Kraken, Consensys, and most recently, Robinhood.

Gensler’s Comments

SEC Chair Gary Gensler recently voiced his frustration with the disproportionate number of crypto-related inquiries compared to those regarding traditional finance.

During an appearance on “Squawk Box,” Gensler noted the overwhelming volume of questions he receives about cryptocurrency, despite it being a relatively small part of the overall market.

Gensler compared the massive $110 trillion capital market regulated by the SEC to the much smaller $2.4 trillion crypto market, highlighting significant concerns.

In a separate interview with CNBC, Gensler avoided similar questions about crypto and even criticized Bitcoin [BTC], stating that it has the leading market share in ransomware.

Regulatory Uncertainty

These incidents suggest that the SEC may be planning to take a stricter approach to cryptocurrency regulation.

Jake Chervinsky, chief legal officer of Variant, recently suggested that it may be time for Congress to step in and provide clarity on the law, due to the current regulatory uncertainty.

When questioned about the SEC’s Wells notice to Robinhood, accusing its crypto services of breaching securities laws, Gensler stated that he couldn’t comment on individual companies.

He also emphasized the lack of essential disclosures for crypto investors and suggested that many tokens are securities under existing law.

In response to this, Paul Grewal, Coinbase’s CLO, disputed Gensler’s claim, stating that tokens are not securities.

These exchanges create a confusing image of the SEC’s stance on cryptocurrencies, leaving many wondering who the SEC’s next target will be.
